Dear Valerio,

In the framework of the workshops for preparing calls 2027, the EC asked the following to all pilot lines:

the original Pilot Lines grant agreements already include access for equipment suppliers (and if I assume only implicitly, materials) to test new tools on the Pilot Lines. How much of this is actually done, and what is the overlap with EC idea on the workshop?"

Yes, this is included, several equipment and material suppliers want to work with PIXEurope. However until Open Access is active, we have not engaged yet. In addition, we will have to be careful to engage with those entities that may also apply to call for tenders of equipment we procure. For those cases carrying uncertainty we will have to wait that contracts of procurement after the tenders are signed.

- "Do hosting agreements and the ancillary economic activity limits of the RTOs allow qualification work for third-party suppliers? And who would own the results?"

As far as I understand, we are not limited by the HA to carry out such types of activity. If it is qualification ("use of equipment and infrastructure" service in our Pilot Line) services strictly speaking, I do not believe IP will be produced. So, the end-user (third-party) can benefit from results of such activities in exchange of paying for the service. If, instead it is "collaborative R&D service, there will be an agreement regulating the IP and know how generated. As you know the idea it would be to retain IP rights for the Pilot Line, so, in that case, likely only non-exclusive rights would be given to the end-user qualifying their equipment or materials.

Disclaimer:
The above is how I see these topics for time being. However, in due course, for such cases and others not fully defined in the Open Access, we will validate with ChipsJU and Commission.

Could you please let me know if you have an answer?

Thank you.

Regards,
Huascar

Best,
Valerio
