<p class="MsoNormal">Following your request regarding the possibility of implementing collaborative R&D projects within the framework of the PIXEurope pilot line, we have consulted the European Commission (DG CNECT).<o:p></o:p></p>

<p class="MsoNormal">The Commission clarified that the PIXEurope consortium must ensure that any activities carried out remain fully compliant with the Hosting Agreement (HA), as well as with applicable State aid and regulatory rules.<o:p></o:p></p>

<p class="MsoNormal">In practice, this means that you may implement this type of collaboration instrument, provided that it remains fully compliant with the HA in particular, with the access conditions provided in Article 19 and Annex V therein. We would also
recommend that this type of arrangement is used only in exceptional cases rather than as a general rule for access to the pilot line.<o:p></o:p></p>

<p class="MsoNormal">We would also like to recall that the access conditions regulated in the HA includes a clause giving the Commission the right of veto regarding open-access arrangements.<o:p></o:p></p>

<p class="MsoNormal">Should any questions or issues arise when implementing such collaborations, you should contact the responsible services in DG CNECT directly to ensure alignment, as also stated in the Annex V of the HA.<o:p></o:p></p>
